1. General Provisions

These Terms & Conditions apply to all contracts concluded between you and Mamas et Babas UG through the website www.sourcebyport.com or through other means of distance communication (e.g. email or telephone).

A consumer is any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business customer is any natural or legal person acting in the exercise of their commercial or independent professional activity.

2. Conclusion of Contract

The presentation of products on our website constitutes a binding offer to conclude a purchase contract under the conditions stated in the respective product description.

The contract is concluded through the online shopping cart system. By clicking the button to complete the order, you submit a legally binding acceptance of the offer and the purchase contract is concluded.

Order processing and communication relating to the contract are carried out primarily by email. Customers must ensure that the email address provided is correct and capable of receiving emails from us.

3. Delivery and Availability

Delivery will be made to the shipping address provided by the customer during the ordering process.

Estimated delivery times are indicated in the product descriptions or during checkout. Delivery times are non-binding unless expressly agreed otherwise.

If a product becomes permanently unavailable for reasons beyond our control, we reserve the right to withdraw from the contract and refund any payments already made.

Partial deliveries may be made where reasonable.

Minor variations in colour, material structure, craftsmanship, or appearance, particularly in products made from natural materials such as leather, do not constitute defects provided that they do not impair the intended use of the product.

4. Retention of Title

All goods remain our property until full payment has been received.

5. Warranty

Customers are entitled to statutory warranty rights under applicable law.

Natural characteristics of leather, including variations in texture, colour, patina development, colour transfer, creasing, and normal signs of wear resulting from regular use, do not constitute defects.

For light-coloured leather products, colour transfer from clothing or textiles, particularly denim or heavily dyed fabrics, may occur despite proper use. Such material-related changes do not constitute a defect.

6. Limitation of Liability

We shall be fully liable for damages arising from injury to life, body, or health, as well as in cases of intent, gross negligence, fraudulent concealment, or where liability is required by law.

In cases of slight negligence, liability shall be limited to foreseeable damages typical for the contract, provided that essential contractual obligations have been breached.

We do not guarantee uninterrupted availability of the website or services.

7. Governing Law

These Terms & Conditions shall be governed by the laws of Germany.

Mandatory consumer protection provisions of the country in which the consumer has their habitual residence shall remain unaffected.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
